论相对人抗辩权在行政听证过程中的保障

On the Protection of Counterpart's Right of Defense during the Administrative Hearing

相对人抗辩权的存在与运行是实现法治行政、和谐行政的重要因素,因而必然要求妥当的保障。文章从行政听证过程的新视角展示了相对人抗辩权保障的理想图景:行政告知是相对人抗辩权的事前保障;公正的行政主体听取抗辩是相对人抗辩权的事中保障;行政说明理由是相对人抗辩权的事后保障。

Existence and operation of the counterpart＇s right of defense is an important factor to realize legal and harmonious administration, which entails appropriate protection. From a new perspective of administrative hear- ing procedure, this article provides an ideal vision of the protection of counterpart＇s right of defense. It suggests that administrative notification is the ante-protection of counterpart＇s right of defense, hearing defense of the just admin- istrative subjects is the mid-protection of counterpart＇s right of defense, and that administrative explaining reason is the post-protection of counterpart＇s right of defense.
