政府信息公开与保密的重要议题:定密异议权及定密异议机制研究

An Important Topic of Government Information Disclosure and Secrecy:Classification Opposition Right and Mechanism

在我国政府信息公开过程中,很多政府信息公开申请被"国家秘密"理由挡回,政府信息公开与保密之间产生了明显冲突。维护公众知情权,需要对国家秘密的确定进行监督。目前我国的定密监督主要存在于行政机关内部,社会监督机制处于缺位状态。定密异议作为一种重要的定密社会监督形式,对保证国家秘密的准确性、促使保密与信息公开的协调统一有重要作用。论文对定密异议权的法理基础、权利属性及要素、定密异议机制的启动条件等基础性问题进行了讨论。

In China,many applications for government information disclosure is rejected by the excuse of ＂state secrets＂ , which results in obvious conflict between disclosure and secrecy.To ensure the public＇s fight to know, there is a need for classification supervision.At present China＇s classification supervision mainly exists in the internal administrative organs, social supervision mechanism is absent. Classification opposition is helpful to ensure the accuracy of classification, coordination of secrecy and information disclosure. This article discusses fundamental issues of classification opposition, including the legal basis ,nature and charac- teristics of classification opposition right and launch conditions of classification opposition.
