村民自治视野下村民代表的权域

Domain of Power of Villager Representatives' in the Perspective of Villagers' Autonomy

根据村民自治制度的设计,村民会议是村级最高决策形式,但是,在很多地区村民会议难以发挥作用,而村民代表会议正在取代村民会议成为民主决策、民主管理、民主监督的主要形式。因此,村民代表权力的运作的合法性就成为成为问题的焦点。根据对村民代表应然权域和实然权域的考察发现,在村庄事务中村民代表的权力运作,既存在着越域,也存在着限域,很多情况下两者并存。要克服上述困境,必须要进一步完善村民自治制度,加强公民教育,探索出消解村民代表权力运作过程中的"合法性困境"的路径。

The villagers meeting is the highest decision-making form of a village,according to the design of villagers autonomous system.However,it is difficult to play its role in some rural areas,where the villager representatives＇ meeting is replacing the villagers＇ meeting and it becomes the main form of democratic decision-making,democratic management and democratic supervision.Then the legitimacy of the villager representatives＇ authority operation becomes the focus of the problem.According to the investigation about the just power domain and real power domain of villager representatives,we find that the villager representatives＇ power operation sometimes goes beyond the domain,while sometimes is restricted less than the domain,and both occur in many cases in village affairs.To overcome the difficulties above,we must further improve the villagers＇ autonomy system,strengthen civil education,and explore the path to overcome the ＂legitimacy dilemma＂in the process of power operation of villager representatives.
