摘要
中国《专利法》第三次修改将"约定优先"原则引入与职务发明奖酬有关的规定之中,在法律上为发明人与用人单位之间提供了平等协商的途径,体现了以民法的理念与原则为核心,构建职务发明制度的基本思路。基于对地方性专利法规立法实践的深入分析,从三个方面对相关法律制度的完善问题进行了探讨。(1)职务发明奖酬制度在地方性专利法规中的现状与特征;(2)地方性专利法规中职务发明奖酬相关规定的缺陷及成因;(3)职务发明奖酬制度在地方性专利法规中的改进与完善。研究的结果表明,现阶段职务发明奖酬制度的立法完善,应着眼于正确认识职务发明奖酬的功能与作用,进一步强化《专利法》中有关规定的落实。
The rewards of employees' inventions belong to the interest allocation of these inventions. It is very crucial for the development and advancement of economy and society in China, and an important component of the Patent Law of the People's Republic of China as well. In order to follow the changes of the Patent Law, the rewards of employees' inventions system in local decrees have to be changed. How to protect the interests of the labor, promote social development and improve intellectual property legislation are all important problems.
