高校学生伤害事故处理的法律探讨

近几年来,在国家政策的鼓励下,高校办学规模日趋扩大,但在校学生人数的飞速增长给学校的管理带来了许多新的困难。鉴于我国高校学生伤害事故频频发生而学校往往疲于应付,我们有必要借鉴国外一些国家处理学生伤害事故的成熟经验。通过加强学生伤害事故预防和处理方面的立法、建立和完善应急机制、将应当由学校承担的赔偿责任转由地方政府财政负担等措施,以妥善处理不断发生的学生伤害事故,实现高校校园的安定与和谐。

In recent years, under the encouragement of national policy, the scale of colleges and universities is expanding rapidly, but the rapid increase in the number of students has brought many new difficulties to the school management. In view of the frequently occurred students＇ injury accident in colleges and universities and the difficulty in its handling, it is necessary to draw lessons from the experience of some foreign countries. By strengthening the legislation in the prevention and handling of students＇ injury accident, establishing and improving emergency mechanism, transferring the responsibility of compensation from college to the local government, we may properly handle students＇ injury accident in the future and build the campus with stability and harmony.
