我国教师资格准入制度的法律审视——兼论《教师法》《教师资格条例》的修改 被引量:3

摘要 我国教师资格制度实施以来,为我国教师队伍建设和教育发展做出了重大贡献,但这一制度在现有的立法框架之内逐步暴露出教师资格准入制度标准偏低、标准不统一、制度的适用空间和时间范围太大以及管理机构混乱等现实问题。构建我国的教师资格准入制度,应当以教师资格制度的实践为依据,尽快修订《教师法》和《教师资格条例》等上位法,提高、规范准入标准,为教师资格准入制度提供法律保障。 Since it came into force,China's teacher certification system has made a great contribution to the construction of teaching team and educational development.However,within the current legislation frame,some problems with the system have begun to emerge.For example,the standard for the admittance is low and not uniform;the spatial and temporal scope of the system application is too large and the administration is messy.The writer of this article believes that the construction of teacher certification admittance system should be based on the practice of teacher certification system,that upper laws like Teacher Law and Regulations for Teacher Qualification should be modified as soon as possible,and that the admittance standard should be heightened,and legal insurance should be provided for the admittance system.
