摘要
美国的《克莱瑞法案》弥补了预防高校校园犯罪案件发生这一立法缺陷,通过制定高校自身的及时预警制度、犯罪日志制度以及年度校园安全报告制度等,保护了高校学生与教职员工的人身财产安全。中国当下的"权利启蒙"与"多元价值"并存的竞争时期,可以借鉴美国《克莱瑞法案》的法条,在高校危机管理中,建立预警保护的中国式《校园犯罪报告法》的立法模式。
The Clery Act Lawsuit of America had solved the problems regarding the prevention of campus＇ crimes through the systems of cutting-edged alarms, criminal logs and annual campus security reports. In order to protect the safeties and properties of students and faculty in colleges and universities, the Clery Act Lawsuit of America had established lateral ties. Therefore, the Chinese government should take the Clery Act Lawsuit of America as the reference to establish the Chinese legislation model ruled by the Campus Crimes Report Law to set up the pre-alarming protect in campus＇ crisis control under the current background of ＂rights enlightenment＂ and ＂multi-values＂ in China.
