摘要
案例教学法在美国法学教育中占有非常重要的地位,是美国法学教育中最主要的教学方法。案例教学法之所以在美国产生与运用,是与美国的法律制度密切相关的。案例教学法的理论基础是建构主义。案例教学法既具有其优势特点也存在着不足之处。我国法学教育应积极采用美国案例教学法,并在精选案例、强化预习、提高教师素质、切实采用苏格拉底式方法、增强师生互信上下功夫。
Case teaching in the United States occupies very important position in the education of law, is the main teaching method in law education. Case teaching method is to produce and use in the United States, is closely related to the American legal system. Case teaching method is the theory basis of constructivism. Case teaching has both the advantages characteristics exist deficiencies. Law education in our country should actively adopt case teaching in the United States, and in select cases, strengthen the preview, improve teachers' quality, effec- tively USES the Socratic method, enhanced the mutual trust between teachers and students.
