当前我国处于社会转型期已是不争的事实,社会转型带来了广泛而深刻的变革,具体到我国的刑事立法领域,犯罪化的立法实践无论在理论上还是实践中都有其存在的必要性,而且具有可行性。犯罪化是社会转型期的必然选择,社会转型是实行犯罪化立法的土壤,只是我们在实践中应不断加强犯罪化立法的科学化、规范化水平。
