“一法一例”在民办中小学教师队伍建设方面的不足与建议

Insufficiencies and Suggestions of "A-law-and-a-Rule" Teachers Building in Civilian-run Elementary and Middle Schools

《中华人民共和国民办教育促进法》和《中华人民共和国民办教育促进法实施条例》(简称"一法一例")的颁布在很大程度上促进了我国民办教育的规范和发展,但是一系列问题也接踵而至。主要有:立法一概化、立法简单化、立法欠针对性等等。针对这些不足与问题,应采取一些政策性措施,主要包括:构建完善的民办中小学教师结构机制;构建完善的民办中小学教师稳定保障机制;建立完善的民办中小学教师社会保险和工资福利待遇机制;建立完善的民办中小学教师培训进修机制;建立合理完善的教师流动机制以及完善立法机制等。

The implementation of the Law of Civilian - Run Education Promotion in People＇s Republic of China and its rule of en- forcement regulation （ AA law and a Rule, for short） achieved a great deal for the norm and development of civilian-run schools, but there still exist some problems, which include singleness, simplification, less pertinency in legislation making. For these in- sufficiencies and problems, the article proposed some policy-type suggestions： to construct sophisticated teacher structure mecha- nisms, teacher stability mechanisms, teacher social security and welfare mechanisms and teacher training mechanisms. Besides a reasonable mechanism to improve the mobility of teachers in civilian-run Elementary and middle schools should be built for the imorovement of legislative system.
