新刑事诉讼法首次明确规定了未成年人附条件不起诉程序,是对近十多年来我国公诉制度改革实践的一个归纳和总结。但在实践中,未成年人附条件不起诉制度面临着对制度本身存在认识误区,控方裁量权缺乏有效制约,考验期内承担义务缺乏针对性等问题。要在检察工作中落实未成年人附条件不起诉制度,需要构建配套的帮教机制,通过内外监督共同制约,并建立完备的司法救济措施。
