“钓鱼执法”法律内涵初探

执法机关在"钓鱼执法"被叫停之后陷入了更为严峻的"执法困境"。这一危机的发生与专家学者对"钓鱼执法"法律性质的误读有直接的关系。这些误读混淆了不同性质的两件事,把没有争议的问题说成在学界有争议,无视中国法律的特点,盲目套用西方学说。为破解"执法困境",有关部门应当正确使用宣传策略,引导舆论力量,出台新的司法解释,为"钓鱼"正名;防范和打击"错钓"等行为,对责任人追究到底;规范"有奖举报"制度的使用。
