摘要
2012年1月1日起开始生效实施的《中华人民共和国行政强制法》规定,行政机关实施行政强制执行可以与当事人达成"执行协议",这是对我国行政强制执行制度的一项变革,是我国首次在行政强制执行的立法中明确执行和解制度。"执行协议"使行政执行方式在权限范围内更加灵活,更加柔和,改善了原有行政强制执行方式过于单一和强硬的不足,有利于行政机关与行政相对人进行沟通,化解矛盾,减少社会冲突,促进社会和谐。但《行政强制法》第四十二条的规定过于笼统,未对执行协议的期限、适用程序等予以明确规定。
