摘要
法治的价值是社会价值,它不以个体为对象却又能使每一个人分享。这种超越个体的社会价值表现在以下几个方面:促进市场经济健康发展,维护发展不可或缺的稳定,保障个体权利、促进社会公平,有助于提升社会道德的整体面貌。如果说价值是善,法治就是大善。是故,价值哲学在价值问题研究中,除了关注个体价值,还应关注社会价值。
The value of the rule of law is a social value which is outside the range of individuals but can be shared by everyone. The social value of the rule of law shown in the following aspects ： promoting the healthy development of the market economy, maintaining the stability which is absolutely necessary for the development, ensuring individual rights and promoting social justice, and improving the overall conditions of social morality. Value is good, the rule of law is a grand good. Hence, I think that value philosophy should be concerned with individual values, and social values at the same time.
