宪法视角下的社区与社会管理创新

Community and Social Management’s Innovation From Constitutional Perspective

从宪法的视角,对传统的社会管理理念进行反思,认为社会管理应当以社会自我管理为主,而不是政府对社会的管理。在此基础之上,笔者认为,社区是社会管理的重要组织之一,并且从法律的角度深入分析了社区的属性。在厘清社区的法律属性之后,探讨了社区在宪法意义上所具有的社会管理创新功能。最后提出社区建设应具备宪政价值,即首先应当明确社区的自主性,其次才是国家权力对社区施加适度的干预。

This paper reconsiders the traditional conception of social management,which shall be given priority to self - management of society but not the government,from the perspective of constitution. On this basis,the authors argue that one of social management’s organizations is community. Furthermore,the authors study the legal characters of community,meanwhile community’s innovative function of social management on constitution level has also been discussed. In the end of the paper,the authors indicate the constitutional value of community building, namely the high priority of community’s autonomy and the complement of state power.
