摘要
学位是一项由"利益"、"资格"和"自由行为"三个基本要素构成的权利。学位授予的法律行为属性,确立了学位权利的合法性和现实性。学位权利的特殊要求,使得世界各国或地区的学位授予中无不包括非学术标准。而非学术标准的内容,则要求学位申请人以及获得者的行为必须符合法律法规、学校规章及社会基本道德规范。
Degree is a right,including ＂interest＂,＂qualification＂ and ＂free behavior＂,and this legal behavior make sure that degree is legal and realistic as a right.The degree as a right requires that nonacademic standards are necessary in degree granting over all the countries and regions.The content of the nonacademic standards means that behaviors of degree applicants or recipients have validity,compliance and morality.
