作为刑法学中规范责任论的核心概念,期待可能性理论最通俗的表述即法不强人所难。自期待可能性理论产生以来,围绕期待可能性的基本概念、在犯罪论体系中的地位、相关判断标准、超法规适用等问题,学者们展开了广泛的讨论,形成了不少研究成果。

The most popular description to the theory of expected possibility is that the law will not force people to do things beyond their power. Since the theory is established, the extensive discussion leads to numbers of publications on the basic concept, the position in the system of the criminal theory, the related criterion for judgment, and some problems in the application surpassing law and regulations.
