韩国老年人长期疗养保险立法的经验与启示

The Experience and Enlightenment of Korean Aged Long-term Care Insurance Legislation

韩国于2007年制定了《老年人长期疗养保险法》,确立了居家疗养优先、灵活性及综合保护等三项疗养原则,对长期疗养给付方式与种类、管理机关与费用承担、疗养机构、人员及设施等作出了细致规定。借鉴韩国长期疗养保险的立法经验,我国应逐步构建老年人长期护理保险制度,采取以社会保险为主、商业保险为辅的保险模式,坚持居家护理和统筹但有区别的护理原则,同时进行专门立法,成立保险管理委员会,对长期护理保险费进行专项管理,加强护理人员的培训,合理界分个人(家庭)、社会及国家的责任。

Korea formulated the aged long-term health insurance law in 2007,which established three health principles that are the home health priority,mobility and comprehensive protection.It＇s content covers payment method and types,management authority and expense bearing,and health institutions,personnel and facilities.Take example by the legislation experience of Korea long-term health insurance law,we should gradually set up the aged long-term care insurance system according to our national conditions,stick to principles of combination of social insurance and commercial insurance,home care and overall plan but differentiated care,formulate specific law,establish the insurance management committee in order to manage the long-term care insurance premium specially,strengthen the training of nursing staff,and define the responsibility between individuals（family）,social and the nation reasonablely.
