Discrimination of Judicial Interpretation of Supreme People’s Court on Cases of Traffic Accidents Compensation for Damages and Its Influence on Insurance

最高人民法院《关于审理道路交通事故损害赔偿案件适用法律若干问题的解释》实施后对保险业的经营及诉讼产生较大影响。本文通过对其主要内容进行解读,分析了保险公司诉讼地位、责任承担、赔偿范围的变化,并指出司法解释中存在争议及尚不明确的内容,在此基础上就保险业如何应对提出建议。

The implementation of ＂Interpretation of Supreme People＇s Court on the law applicable to cases of traf-fic accident compensation for damages＂ has a great impact on the insurance business and its litigation. Through an inter-pretation of the major contents, this paper analyzes the changes in lawsuit position, liabilities, compensation scope of the insurance companies, and points out the controversial and uncertain contents interpreted. Based on this, the paper pro- poses relevant suggestions for the insurance industry on how to deal with it.
