摘要
"赔命价"在传统社会作为一种法文化对解决杀人案件具有重要的影响。但在基本理念上,"赔命价"与我国刑法之间有着很大的差别。从构建和谐法治的视角来审视,"赔命价"对我国的刑事法治建设又具有一定的借鉴作用。
As a kind of traditional Legal culture, the life compensation has main effect on solving murder cases in practice. There are significant differences between Life Compensation and National Criminal Statutes on basic con- cept. From the perspective of constructing harmonious rule of law, life compensation makes certain contribution to the construction of Rule by Criminal Law in China.
