关于我国非法证据排除规则适用的若干问题探析

随着《关于办理刑事案件排除非法证据若干问题的规定》、《刑事诉讼法》修正案的颁布实施,我国虽然构建起了非法证据排除规则的基本框架。但对"刑讯逼供等非法方法"的界定,排除申请的提出时间,排除程序启动的证明标准等问题应作进一步的细化和完善。

As the amendments ＂On some issues to handle criminal cases of illegal evidence exclusion rules＂ and ＂Criminal Procedure Law＂ are issued and implemented, our country builds the basic framework of illegal evidence exclusion rules. But there are still some problems such as the delimitation of ＂the illegal ways of torture＂, the time of applying exclusion, the certification standard of starting the exclusion program should be refined and perfect.
