失地农民权利保障视角下的农地产权制度研究

Research on Agricultural Land Property Rights System in the Perspective of Protecting the Rights of the Landless Peasants

随着工业的不断发展和城镇化改革的不断推进,农民在土地被进行重新配置的过程中,被迫失去原来赖以生存的物质条件和就业机会。当前的法律法规对于农地产权制度的规定不能从根本上解决失地农民权益受损的社会状况,因此,有必要对农地产权制度的规定及其缺陷进行分析,从深化农地产权制度入手,改善农地承包关系,更妥善地解决当前中国的失地农民权益保障的问题。

As progresses in manufacture and urbanization reform are promoted constantly,peasants are forced to deprive of material conditions and job opportunities what they live on.The provisions of existing laws and regulations on agricultural land property rights system cannot solve the social status.So it is necessary to analyze the rule and disadvantage of property rights of agricultural land.Based on promotion of property rights of agricultural land,change the relationship of land contract then solve the problem of the protection of the rights of landless peasants.
