领导干部法治思维探析

Legal Thinking——A New Way of Evaluating Leader's Ruling Ability

善于运用法治思维推动改革深化、促进经济社会发展、化解社会矛盾、维护社会稳定,是衡量领导干部执政能力的新标准、新要求。用新标准、新要求来衡量,当前领导干部的法治思维能力亟待提高,这突出表现在:在部分领导干部中法律虚无主义和法律工具论仍有市场,以权力为本位忽视公民权利,法律信仰缺失、法律意识落后、法治思维习惯尚未养成等方面。要提升领导干部的法治思维能力,必须加强法律学习,培育法治文化;注重法治观念的更新;以制度创新促成法治信仰的形成;调整法治宣传教育的重点。

In the new historical starting point of＇ building a well-off society in an around way and opening new process of rule by law in China, the leaders and cadres of party and from different government levels are facing reform, development and stability tests in the key period of transformation. The ability of leaders to deepen reform, promote economic and social development, resolve social conflict and keep social stability by using legal thinking and the measures of rule by law appropriately is the new standard and new requirement to evaluate theirs quality. The promotion of leaders ruling ability on legal thinking and rule by law is the way for meeting people＇s increasing demand for fairness and justice, and is the choice for breaking through reform, development and stability and is the guarantee for transforming ruling way, promoting ruling ability and keeping the party＇s vanguard nature and purity. In order to fulfill the aim of building a well-off society in an around way and a long period of stability of the nation, leaders are asked to transform the ruling thought of ＂rule by man＂ to ＂rule by law＂ and to cultivate the legal thinking and spirit for them to promote their ruling ability, maintain the unity of legal authority and rule by law to play the more important role of legal in ruling and social management.
