摘要
劳动关系是雇佣关系的社会化,劳务关系则外延广泛。运用比较法的研究方式辨析劳务关系、雇佣关系、劳动关系三者的联系与区别,从而找寻出船员在雇佣过程中受伤,船东承担相关责任的正确法律依据,以解决司法实践中适用法律不统一的问题。
Work relationship is the socialized employment relationship while the labor relationship has a wider scope. This pa- per, by way of comparative analysis, explores the connection and difference between labor relationship, employment relation- ship and work relationship, with a view to finding out the proper rule for holding the ship owner liable for the personal injury of the crew member during employment and solving the problem of application of different laws in the same case.
