摘要
本文从法律角度对避碰规则进行了研究,认为它是一份具有较强技术性的法律规范性文件,是我国海商法的渊源,它属于国际私法范畴,论证了违反它的后果,并将避碰规则中的法律规范进行分类,针对规则调整对象的特殊性,提出了严格强制性规范和非严格强制性规范的概念.
In this paper, 'the collision regulations 'is discussed from the view point of law and it is concluded that it is a norm of law with a strong technical nature and that it is a part of the international private law and that it is one of the sources of the maritime law of China. And the effects of
the breach of it are discussed. The norm of it is classified, and two concepts-strict mandatory
norm of law and non-strict mandatory norm of law-are offered.
