中国食品安全监管体系改革的法律思考

Legal thinking on reform of food safety regulatory in China

近年来,中国食品安全监管问题层出不穷,主要原因是食品安全监管体系落后、相关食品安全监管立法滞后、食品安全预警机制和风险评估机制不完善、可追溯性制度和缺陷食品召回制度未能与国际接轨。文章在认真分析中国食品监管现状和借鉴发达国家食品监管经验的基础上,提出了中国食品安全监管改革的对策。

In recent years, regulatory problems of food safety in china emerge in endlessly, the main reason is the supervision system of food safety falls behind, the legislation of supervision of food safety lags, the system of food safety pre-warning and risk assessment mechanism are not perfect, traceability system and defects food recall system fail to conform with international. This paper on the basis of the careful analy- sis of our country＇s food regulatory situation and draw lessons from the developed countries food supervisory experience, put forward the coun- termeasure of regulatory reform of food safety in china.
