摘要
不动产物权的移转存在着合同和登记两个过程。通过对法、德民法中物权公示制度利弊的分析 ,比较真实权利人及善意第三人利益在两种立法例下的不同结果 ,即保护意思自治或保持交易安全 ,提出设立保护交易安全登记制度模式及相关配套的制度完善。
Immovable property transferring exists in two processes of contract and registration.Comparing the adavantage and disadvantage of propety system in France and Germeny and the diffent results of the property owners and the third persons,the paper proves the improvement of protecting and registrating transcetion security.
