本文概括了我国自然文化遗产资源产权制度的历史变迁,并分析了目前产权制度的特点。认为目前自然文化遗产资源产权制度构建的重点不是如何强化法律和完善制度,而应该在于如何考虑遗产地原住居民的利益诉求,从而构筑完全的产权结构。在此基础上分析了民众参与作为替代性制度安排的优越性。

this paper outlines the historical changes of property right system of China＇s natural and cultural heritage, and on the analysis of the current features of the property rights system. Believes that the current focus of the property rights system of natural and cultural heritage resources is not about how to strengthen and perfect the system of laws, is to consider heritage should be taken to the original inhabitants of interest demands so as to build a full property right structure.
