On the Protection of Creditors from Creditors Conference in Bankruptcy Law

债权人会议是债权人参与破产程序,维护其利益,具有独立意思表示能力的自治团体。完善的债权人会议制度对于保护债权人利益起着举足轻重的作用。通过对《破产法》中债权人会议制度的相关规定的探讨,以消除现有债权人会议制度的弊端为视角,提出了完善债权人会议制度保护债权人利益的建议。

Creditors conference refers to a self-governing body in which the creditors safeguard their interest and independently express their ideas when dealing with matters related to bankruptcy. A perfect creditors conference system plays an important role in the protection of creditors＂ interest. This paper discusses the regulations related to the creditors conference system in ＂ The Bankruptcy Law＂ in order to diminish the related defects and to protect their interest more properly.
