摘要
本文在中国农村乡规民约与国家法关系的基础上 ,认为以民事、婚姻为主干的乡规民约与国家法之间存在着某些矛盾 ,但这些矛盾又是可以协调的。因为它们二者在本质上是一元化的规范体系 ,即乡规民约服从于并服务于国家法律 ,前者仅是后者的有益补充。在此前提下 ,本文提出了协调矛盾的建议 :国家法在一定条件下应允许合理的乡规民约的存在与发展 ;而乡规民约也只能是作为国家法律不健全的一种权益之计 ,一旦某方面的法制健全、完善了 。
Based on the analysis between rural law and national law,the author thinks that the conflict between rural law,which is based on civil and marriage,and national law may be resolved,for they both belong to the same paradigmatic system in nature,that is ,rural law not only is subjugated to but also serve the national law,and the former is a necessary supplement to the latter.Thus,in the final section,some suggestions are put forward to balance the conflict,national law should allow rural law to exist and develop themselves to some degree,while rural law can only act as a makeshift device because of the inadequacy of the national law in this respect,once the national law is fully developed,the rural law should die away.
