当前艾滋病犯人监管尴尬境况的处理对策

Response to the current embarrassed supervision of AIDS infected criminals

随着中国艾滋病疫情的逐年上升,艾滋病病人犯罪现象也随之逐年增多,一些病人利用人们对艾滋病的恐惧心理从事违法犯罪活动,在某些地方已发展为严重的社会问题。而公安司法部门在处理此类案件时的一些做法引起人们的不安。在全国各地,有关艾滋病罪犯屡抓屡放的报道频频见诸各媒体报道。如何正确处置这类事件成为一个迫切需要解决的问题。文章就艾滋病罪犯在监管中出现的困境进行了分析,并提出了相应对策:提高公安干警艾滋病知识水平;尽快出台专门法律,统一执法;设立艾滋病犯人专门关押区;加强公安干警艾滋病职业暴露防护培训,建立制度保障;管教医疗相结合,消除艾滋病犯人反社会心理;加大保外就医、监外执行罪犯的监管力度等。

With the acquired immunodeficiency syndrome（AIDS） epidemic rising in China, crimes committed by people living with AIDS is increasing year by year. Some AIDS patients are engaged in criminal activities by using fear of AIDS, which has become a serious social problem in certain areas. Meanwhile, inadequate actions taken by public security and judicial departments in dealing with such cases have aroused unrest among the people. The events that AIDS-related offenders are repeatedly caught and repeatedly released have been frequently reported in the media. Therefore, the issue how to properly handle human immunodeficiency virus（HIV）/AIDS infected criminals presents an urgent need. This papers analyzes the embarrassed supervision of AIDS offenders and recommends relevant responses. Among other things, it is essential to upgrade knowledge of HIV/AIDS among public security officers, formulate specific laws and regulations regarding supervision of AIDS affected offenders and unify law enforcement; a special location should be designated to detain AIDS infected offenders; training for protection of occupational exposure among public security officers should be strengthened and related security system be established. Prisoner supervision should be combined with medical care to eliminate anti-social psychology among people living with AIDS. Medical parole, as well as supervision of criminals outside prisons, should be enhanced.
