从确认法袍作为西方法治文化的象征意义入手 ,着重介绍法袍的文化功能 ,这些功能表现为 :宗教化、形式合理性、司法独立的“屏障”以及戏剧审美价值。通过对中国传统法律文化的分析 ,指出法袍的引入会对中国产生怎样的影响以及我们对法袍应持的态度。

This article begins from the symbolic significance of a judge's robe in the Western culture of the rule of law and emphasizes cultural functions of this robe. These functions have expressed: Religion, reasonableness in form, protection of judicial independence and the drama's value in appreciation of the beauty. By analyzing Chinese traditional legal culture, the author thinks the import of judge's robe will cause certain effect and the attitude we should take.
