摘要
本文从事业单位聘用合同法律出发,剖析了有关法律缺乏竞聘机制的相关条款,分析了造成运用竞聘机制无法可依的原因是没有配套专门的事业单位人事管理法律法规以及目前现有的事业单位法律法规不够完善,提出了将竞聘机制法定化和借鉴香港高等学校竞聘机制的解决措施。
Starting from employment contract law for public ser- vice units, this paper analyzes relevant legal items lacking com- petitive mechanism and the causes, that is, the lack of special laws and regulations for personnel management of public service units, and the currently imperfect lays and regulations, and rele- vant solutions are also proposed.
