从“任建宇案”反思劳动教养制度

Reflection of Labor Reeducation System from "Ren Jianyu Case"

劳动教养制度是我国一项特有的法律制度,在预防犯罪、维护社会治安和社会稳定方面发挥了重要作用,但其固有的缺陷导致在执行实践中带来了种种问题。在反思"任建宇案"的基础上,分析了劳动教养制度的弊端,提出了改革完善劳动教养制度的具体措施。

The system of labor reeducation is a unique legal system in our country, and has played an important role in the prevention of crime, in the maintenance of social order and social stability. But its inherent defects lead to problems in the implementation of the practice. On the basis of the ＂Ren Jianyu Case＂, this paper makes an analysis on the drawbacks of the system and proposes specific measures for improvement.
