中国行政复议制度不适应现实需要,基础理论滞后是其中一个重要原因。近代以来世界主要国家行政复议发展的历史证明,没有基础理论的重大突破,就没有行政复议制度的完善。开展行政复议基础理论研究,必须从中国国情出发,努力解决中国现阶段的具体问题,形成具有中国特点的行政复议制度。

For China＇s administrative reconsideration system being unsuitable for the practice, thebasic theory hysteresis is a significant reason. It is proved by major countries＇ administrative reconsideration development history in modem times that without a major breakthrough of the basic theory, there will notbe improvement of the administrative reconsideration system. Therefore, to explore China＇s basic theory of administrative reconsideration, China＇s unique national conditions must be started from and specific questionsin current China should be paid efforts to in order to form an administrative reconsideration system with Chinese characteristics.
