论我国环境行政管理体制存在的问题及其完善

On Problem and Perfection of China’s Environmental Administrative Management System

为完善我国环境管理体制以满足社会发展需要,我国应制定"环境管理组织法",将环境管理体制改革纳入法制轨道;要明确各环境管理机构的职权划分及其权责义务,为此要处理好三个问题,即中央与地方的环境管理权限界分,统管与分管部门的职能界分,地方环境保护主管机关与地方政府的关系协调;要引入环境管理的社会参与机制,要全面引入绿色GDP评价体系,以改变现有政府的激励机制。

In order to consummate China＇s environmental management system to meet the requirement of social development, the Organic Law of Environmental Management should be laid down in China, to bringenvironmental management system reform into legal orbit. The function and power division, the responsibility and obligation of separate environmental management organ should be made clear. To achieve this goal, threeissues should be properly dealt with, which are, demarcation of central and local environmental management authorities, functional demarcation of unified management and separate control departments, and relationshipcoordination between local environmental protection competent authorities and local governments. Social participation mechanism should be introduced into as well as comprehensively the green GDP evaluationsystem to change the present government incentive mechanism.
