摘要
台湾地区"大法官"在两个层面上对大学自治进行解释:在大学与国家公权力层面上,通过第380、450号解释,使大学自治获得宪法保障,不仅可以对抗行政机关的不法干涉,亦可以对抗立法者的不当干涉;在大学与其内部成员权利层面上,通过第382、684号解释,破除了传统的学校特别权力关系,学生获得了全面的诉讼请求权,使大学自治受到了制约。为平衡大学自治与权利救济,第462、563、626号解释构建了正当性审查的基本框架。其解释可为我们参考和借鉴。
Taiwan "Judge" interpreted university autonomy from two aspects. From the aspect of the university and the national public power, university autonomy was safeguarded by the interpretation of the 380th and 450th, which could remove the intervenes of the ad ministration and the law enforcement agency; from the aspect of the university and the rights of internal members, university autonomy was restricted by the interpretation of the 382th and 684th, removing the traditional special power of the university and investing students with the full claim rights. To balance university autonomy and its internal members right re- lief, the interpretation of the 462nd, the 563rd and the 626th constructed the frame of legiti- macy review, which could offer beneficial references for us.
