A Way Out of the Sieyès's Vicious Circle:An Illumination of the Legitimacy of the Philadelphia Constitutional Convention by Hannah Arendt

费城制宪会议是决定美国历史命运的一个重大事件,然而对费城制宪会议的正当性的质疑使其从召开伊始就遭遇到反联邦主义者的反对。文章首先试图厘清费城制宪会议之正当性问题的实质,指出美国制宪会议所遭遇的难题其实是一切开端性的制宪会议所必然遭遇的西耶斯恶性循环问题,然后尝试根据阿伦特的一些文本论述,梳理其对费城制宪会议之正当性的一种解读,并尝试提出权威是权力之异化的新理解。

The Constitutional Convention of 1787 in Philadelphia is one of the greatest events that direct the course of the American political developments. Because of the doubts for its legitimacy, the Convention incurs itself severe objections from those anti-federalists ever since the beginning. The article dedicates to define the aporia of the legitimacy of the Philadelphia Convention in the first place, arguing what the Convention confronts is virtually the problem of the Sieyes＇ vicious circle that all constitutional conventions have to be in face of. The following parts focus on an analysis of how Arendt coping with this aporia according to some of her texts and put forward a new understanding of the authority as the alienation of the power.
