Analysis of the Procedural Law on Shipai System of Yao People——In the Perspective of Procedural Justice

瑶族的石牌制以其特殊的组织机构和运作方式,曾经在瑶族的社会管理和纠纷解决过程中发挥过重要作用。当前,石牌制作为一种村规民约,在瑶族地区有复生迹象。作为历史上的一种重要的纠纷解决机制,石牌制体现了朴素的程序正义的思想。但是,作为一种缺乏规制的民族习惯法,它具有本身难以克服的弊端。在新的历史时期,如何充分发挥石牌制在瑶区社会管理,尤其在纠纷解决中的功能,充分实现石牌制定纷争的价值,是我们必须关注的一个问题。

Shipai System of Yao People had played an important role in social management and conflicts settlement through its special mechanism and operating approach. At present, the function of Shipai system seems to revive among Ya0 peo- ple. As an important approach of settling disputes in past time, Shipai system displayed a simple idea of procedure and justice. However, as a kind of unwritten law of ethnic group, Shipai system has no specific regulations, which is a vital disadvantage. Nowadays, we should pay high attention to how to play the function and value of Shipai system in social management and disputes settlement among Yao People.
