摘要
足球俱乐部通常在与球员的雇佣合同中插入单边延期选择条款,赋予俱乐部单边延期或取消合同的权利。大量案例表明,国际足联对于仅有利于俱乐部的单边延期选择条款通常认定为无效。为了减少与各国国内法的冲突,国际足联逐渐放宽了标准,将合同的延展期限、选择权行使的告知时间、薪水报酬、双方当事人的地位以及选择权条款在原始合同中的表述这5个因素作为确定该条款是否有效的标准。在我国,对于单边延期选择条款效力的认定,应当在符合《劳动合同法》的公平原则、平等原则以及合同自由原则的前提下,采取与国际足联相一致的做法,以促进国际足球世界争议解决制度的协调与统一。
Football clubs usually provide their employments agreements with unilateral extension option clause in favor of the clubs which is considered to be valid to give them the right to extend the employment contract unilaterally. However, FIFA' attitude is quite cautious in order to protect player' legal right. This article summarizes the standards of determining the validity of the unilateral option clause in favor of the club through citing the cases of the Dispute Resolution Chamber of FIFA.
