摘要
首先总结了欧盟、美国、新西兰及韩国在实施碳排放权交易过程中制订遵约机制的经验,其次初步分析了为保证我国碳排放权交易的顺利实施,在遵约机制设计过程中所涉及的诸多关键问题,包括法律基础、惩罚形式、罚款额度、罚款机构、罚款所得管理办法等。最后,根据我国国情,针对这些问题的解决提出了相应的政策建议。
This article first summarized the experiences in implementing a compliance mechanism of carbon emissions trading system in the European Union, the United States, New Zealand and Korea. For ensuring the implementing of China ETS, some key issues for establishing compliance mechanism of CO2 emissions trading in China are discussed, including legal foundations, the format of penalty, penalty amount, penalty organizations, how to manage the fine and so on. And corresponding policy recommendations are made at last according to China＇s national conditions.
