摘要
独立学院作为一种新型的办学模式,由于国家相关政策法规建设滞后和高等教育管理体制中存在的弊端,以及独立学院自身微观制度建设的缺陷,导致目前独立学院管理机制存在产权界定不清晰、董事会运作不规范、权力运行失衡、教师激励不足、内部监督约束缺失等问题。治理理论是基于公共事务管理机制的一种创新。法人治理结构是解决组织内部各治理主体契约关系安排的一种具体组织结构形式和控制机制。借鉴治理及法人治理结构理论成果,建立"两权"分离机制、科学决策机制、权力制衡机制、教师激励机制、管理问责机制,是完善独立学院管理机制的现实选择。
An independent institute,as a new mode of running schools,has inherent defects in its management mechanism : uncertified ownership,non-standardized operation of the board,imbalance of powers,lack of incentives for teachers and inner supervision,etc.All these defects are due to the backwardness of the related national laws and regulations,and the drawbacks in the administrative system of the higher education as well as the defects in the construction of micro-system of independent institutes.The governance theory is an innovation based on the operating principle of public affairs administrative mechanism.The management system run by the juridical person is a specific organization pattern and supervising mechanism,which is a solution to the contractual rela-tionship between the main bodies in the management operation.It is a practical choice for independent institutes to apply the governance theory and the theory of management structure by the juridical person as reference,so as to establish a comprehensive operational system with the ' two powers ' separation mechanism,scientific decision-making mechanism,power balancing mechanism,incentives to the teachers,and power with responsibility mechanism.
