摘要
为了稳定劳动关系,《劳动合同法》确立强制续签制度、禁止约定终止条件制度、收紧法定解除制度"三管齐下"来严格控制无固定期限劳动合同的解除。通过立法推进框架下考量解除的演进,无固定期限劳动合同协商解除,劳动者单方解除,用人单位单方解除,客观不能及经济性裁员五个方面详细分析了无固定期限劳动合同的解除适用情况。
For stability of labor relation, labor contract law has established the compulsory system of continuing to sign, the prohibition agreement system of terminal condition, and the strictly controlling system of legal rescission. There are three ways to strictly control rescission of flexible-- term labor contract. Study on the evolution of rescission in the framework of leg- islation , the rescission of flexible--term labor contract by negotiation, workers rescind the contract unilaterally, the employers rescind the contract unilaterally, objective inability and economic dismissal. This paper detailed analysis applicable conditions of rescission of flexible--term labor contract from the above five points.
