On the Fundamental Legal Problems of Logistic Business

现代物流企业是一种集多种业务于一身的综合性的大型服务企业。相对于传统物流业而言,现代物流业提供的服务要复杂得多。在现代物流业务运作模式中,由于其涉及物流主体的多元化、展现物流业务流程的复杂化、责任承担的多样化,与传统规范如运输、仓储、货代等某一环节物流业务的法律规定之间存在不少冲突,分析和研究现代物流业务中的法律问题具有重要现实意义。应根据现代物流发展速度与现状,从物流概念的法律性质、物流主体识别、物流行为归属、物流经营责任制度等方面入手,解决当前物流业务中面临的关键性法律问题,在不断完善现有采购、运输、仓储等物流环节法律规定基础上,着手制定统一的物流相关法律法规。

Modem logistics industry is the large comprehensive service industry providing diversified business. Comparing to the traditional logistics industry, modem logistics industry can provide more complex services. In the operation pattern of modem logistic business, because of the diversified logistics subjects, the complicated business process, and the diversified responsibilities, there are some conflicts with traditional norms. We should, according to the development and current situation of modem logistics and in terms of the legal nature of logistic concept, the identification of logistic subject, the attribution of logistic behavior and the liability system of logistic operation, solve the critical legal problems with logistics business and formulate the unified logistics related law and regulation based on the continuous improvement of the current purchasing, transportation and storage related law and regulation.
