服务合同的一般规则研究

Research on General Rule in Service Contract

不同于物型合同,服务合同有其独特的特征。传统的合同法理论对服务合同有些并不适用,因此我们有必要对服务合同进行不同于一般合同类型的研究。本文对服务合同的一般规则中较为典型的亲自履行原则、随时解除原则、服务合同当事人的注意义务、服务合同当事人的损害赔偿责任、服务合同规则的准用问题以及服务瑕疵等进行了分析。

Abstract ： Different from the general type of contracts, theory of contracts does not apply to service contract, service contracts have their unique characteristics. The traditional so it is necessary for us to carry on some different research on service contracts with the general type of contracts. This paper analyses the general rules of service contracts, such as the personal performing principle, dissolution of contracts, the duty of service contract, service contract party＇ s liability for damages, the application rule of service contracts and the flaw of service.
