比较文化背景下中国检察权改革的路径选择

On Routes of Reformation of Chinese Prosecutorial Power under the Background of Comparative Culture

中国检察权的建构模式虽然是"一权之下分三权"的模式,但现实中的表现并不尽如人意。这与我国御史监督的文化弊端有一定关联。虽然西方的检察建构文化冲击了中国的检察权构建模式,不过中国检察权的实质影响因素仍然是对个人负责而不是对人民负责的法律工具文化。在我国宪法文本靠拢西方权力制约文化的趋势下,有必要在司法生活中正本清源,还原检察机关的宪法地位,其改革的路径应当不冒进的线路下充分发掘自身的权力范围。

Although Chinese prosecutorial power has been under the decentralization system, there still exists some disadvantages in practice, which mainly comes from our traditional culture of Censor Supervision. With the society developing quickly, the western prosecutorial culture has brought great shock to our building mode, whose essence is still responsible for individual not people. Therefore, under this condition, it is necessary to reconstruct the procuratorial organ＇s constitutional status so as to make the best of its routes of reformation.
