摘要
海洋生态的损害既包括海洋环境污染也包括海洋资源破坏。海洋生态损害,是对海洋系统的直接侵害,海洋不再是媒介的作用,而是受损对象,直接导致海洋生态功能的丧失。海洋生态损害是人为因素引起的民事侵权行为,侵犯的是国家财产所有权,海洋生态损害作为一种特殊的侵权行为,因果关系的认定比较复杂,构成要件宜采取"二要件说"。
The marine ecological damage includes the pollution of the marine environment and the destruction of marine resources. It is the direct violation of marine system. The sea is not the role of the media, but the damaged object. It leads to the loss of the marine ecological function. It is the civil tort that is caused by the human factor. It infracts the national property ownership. As a special tort, the cognizance of causation is complex, and ＂two elements＂ should be taken.
