On the New Definition of Safety Obligations

安全保障义务既包括避免权利人因为自己的内部原因而受到损害的作为义务,也包括避免权利人因为第三人的外部原因而受到损害的作为义务。从"爱你的邻人"理念的发展历程可以发现,第一方面其实属于一般安全注意义务的范畴,安全保障义务仅仅是指第二方面。

Generally, safety obligations includes one action duty which means letting obligee avoid damages because of the intemal rea- sons and another action duty which means letting oblige avoid certain damages because of the external reasons. From the development course of the concept ＂Love your neighbor＂, we can find that the first one belongs to the category of safety attention duty, and safety guarantee duty belongs to the second one.
