摘要
2007年5月1日我国颁布实施了《人体器官移植条例》,这无疑是一个里程碑式事件,引导着我国器官移植的健康发展。但是,该条例规定的过于粗糙,不具有可操作性,其中一些基本问题更是急需补充和完善。本文从法条出发,分析条例中存在的不足,并借鉴国外的做法提出相应的完善建议。
China promulgated ＂Organ Transplantation Regulation＂ on May 18,, 2007, which is a milestone for the healthy development of organ transplantation in China. However,the problem is that the ＂regulation＂ is lack of feasibility. Some basic items need to be complemented and improved. Based on the items of law ,the inadequacy is analyzed with suggestions.
