A Study of Nation-state,EU and Reconstruction of the Historical Concept of Modern Constitution

现代宪法学认为,民族国家是现代宪法的社会基础,民族国家产生之前或消亡之后不存在宪法。因此,宪法的历史与民族国家的历史相同。然而,以欧洲共同体为基础的《欧盟宪法》表明,宪法与民族国家并不存在必然的联系。这挑战了现代宪法的历史观,并为重构宪法学的历史理论提供了契机。

Modern constitutional studies holds that the nation-state is the social foundation of modern constitution because there is no constitution before the emergence or disappearance of the nation-state. Thus, the history of a constitution goes with the history of a nation state. However, the EU Consti- tution Treaty does not accept this concept and holds that there is no necessary connection between a constitution and a nation-state, which challenges the historical concept of modern constitution and of- fers opportunities to the reconstruction of constitutional studies in the historical perspective.
